Protect Your PC – Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between Protect Your PC Pty Ltd ACN [insert ACN] (“Protect Your PC,” “we,” “us,” or “our”) and the client (“Client,” “you,” or “your”). By engaging or using any services provided by Protect Your PC (“Services”), including but not limited to granting remote access, scheduling, or receiving Services, the Client acknowledges and agrees to be bound by these Terms in their entirety.

These Terms operate in conjunction with Protect Your PC’s Privacy Policy, Client Disclaimer & Liability Waiver, Remote Access Authorisation & Informed Consent, Service Consent Form & Digital Client Agreement, and any other relevant client-facing documentation.

1. Scope of Services

1.1 Protect Your PC provides remote IT and cybersecurity services within Australia, which may include but are not limited to:

  • Identification, detection, removal, and remediation of viruses, malware, ransomware, spyware, and other digital threats;

  • Installation, configuration, renewal, and support of antivirus or endpoint protection software (including third-party products such as ESET);

  • Provision of general cybersecurity advice, risk assessment, and auditing services.

1.2 Exclusions: Unless explicitly agreed in writing, Protect Your PC does not provide:

  • Onsite technical support or hardware repair;

  • Hardware diagnostics, repair, or replacement;

  • Data recovery or forensic investigation;

  • Ongoing system monitoring or management beyond the scope of individual service sessions.

2. Nature and Limitations of Services

2.1 The Client acknowledges that:

  • Services are provided remotely and are contingent upon the Client’s internet connectivity, system functionality, device integrity, and accuracy of information supplied;

  • Protect Your PC is reliant on the Client’s cooperation and provision of access, permissions, and credentials necessary to perform the Services;

  • Protect Your PC does not warrant, guarantee, or represent that all issues will be fully resolved; particularly in circumstances involving pre-existing system defects, hardware limitations, or severe malware infections;

  • All Services are provided on a best-efforts basis. No representations, warranties, or guarantees, express or implied, are made regarding the outcome or efficacy of the Services.

3. Client Responsibilities

By engaging Protect Your PC, the Client agrees to:

  • Ensure legal ownership of or authorised access to all devices, systems, and software subject to the Services;

  • Maintain software licences, updates, and renewals as required;

  • Comply with all cybersecurity guidance, recommendations, and post-service instructions provided by Protect Your PC;

  • Indemnify and hold harmless Protect Your PC against any loss, damage, liability, or claim arising from failure to follow recommendations or user error.

4. Software Licensing and Third-Party Products

4.1 Protect Your PC may recommend, install, or configure third-party software, including antivirus or endpoint protection products.

4.2 The Client acknowledges that:

  • Protect Your PC is not the manufacturer, vendor, or licensor of any third-party software;

  • Protect Your PC makes no representations or warranties regarding the long-term performance, reliability, security, or compatibility of any third-party software;

  • All obligations relating to licences, renewals, maintenance, or compliance with third-party software are the responsibility of the Client;

  • Any claims, disputes, or issues relating to third-party software must be addressed directly with the software vendor.

4.3 The Client assumes all risk arising from the installation, configuration, or use of third-party software, including potential system conflicts, data loss, or temporary unavailability of functionality.

5. Limitation of Liability

To the maximum extent permitted by law:

  • Protect Your PC, its officers, employees, contractors, and affiliates shall not be liable for any:

    • Loss, corruption, or destruction of data, files, or software;

    • System downtime, device malfunction, or diminished performance;

    • Financial, operational, or consequential loss;

    • Issues arising from third-party software, pre-existing conditions, or Client actions.

  • The aggregate liability of Protect Your PC for any claim whatsoever, whether in contract, tort, negligence, or otherwise, shall not exceed the fees paid by the Client for the specific Service giving rise to the claim.

6. No Guarantee of Security

6.1 The Client acknowledges that no Service, software, or system configuration can provide absolute protection against malware, cyberattacks, data loss, or other digital threats.

6.2 The Client further acknowledges that ongoing system security is contingent upon:

  • Adherence to safe computing and cybersecurity practices;

  • Timely software updates and patching;

  • Proper implementation of backup, recovery, and security measures.

7. Remote Access Terms

7.1 By permitting remote access, the Client consents to:

  • Access being provided via secure remote software such as Zoom, Microsoft Teams, RustDesk, or ESET tools;

  • Access being strictly limited to areas necessary to perform the Services;

  • Termination of the session at any time by the Client;

  • No storage, retention, or copying of personal data, login credentials, or files beyond the duration required to complete the Services.

8. Confidentiality and Data Handling

  • Protect Your PC shall treat all client data, credentials, and system information as strictly confidential;

  • No client data shall be retained, copied, or disclosed except as necessary to perform Services or as required by law;

  • Protect Your PC offers Non-Disclosure Agreements (NDAs) on request.

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State or Territory of Australia in which the Client resides or conducts business. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of that State or Territory.

10. Australian Consumer Law

Nothing in these Terms purports to exclude, restrict, or modify rights conferred under the Australian Consumer Law (“ACL”) that cannot be lawfully excluded. Where permitted by law:

  • Protect Your PC’s liability under the ACL is limited, at Protect Your PC’s discretion, to either re-supplying the Services or refunding the fees paid for the Services;

  • All other warranties, guarantees, or implied conditions are expressly disclaimed.

11. Acceptance of Terms

By engaging Protect Your PC, the Client confirms that:

  • They have read and understood these Terms;

  • They accept all risks associated with remote IT services, cybersecurity support, virus removal, software installation, or configuration;

  • Protect Your PC shall not be liable beyond the limitations expressly set forth herein.
