Protect Your PC – Terms of Service

These Terms of Service (“Terms”) form a binding agreement between Protect Your PC (“we”, “us”, “our”) and you, the client (“you”, “your”). By scheduling or receiving our Services, granting remote access, or using any Services provided by us, you acknowledge that you have read, understood, and agree to these Terms in full.
These Terms operate in conjunction with our Privacy Policy, Client Disclaimer & Liability Waiver, Remote Access Authorisation & Informed Consent, Service Consent Form & Digital Client Agreement, and any other relevant client-facing documents issued by Protect Your PC.
1. Scope of Services
1.1 We provide remote IT services within Australia, including:
Identification, detection, and removal of viruses, malware, ransomware, spyware, and other digital threats
Installation, configuration, renewal, and support of antivirus or endpoint protection software (including ESET products)
Basic cybersecurity advice, guidance, and auditing
1.2 Excluded Services: Unless expressly agreed in writing, we do not provide:
Onsite support or physical repairs
Hardware diagnostics or replacement
Data recovery or forensic investigation
Ongoing system monitoring beyond individual service sessions
2. Nature and Limitations of Remote Services
2.1 You acknowledge that:
Services are delivered remotely and depend on your internet connection, device condition, operating system stability, and the accuracy of information you provide
We rely on your cooperation and permissions to perform work
We do not guarantee full resolution of all issues, particularly where pre-existing system problems, severe infections, or hardware limitations exist
All services are provided on a best-effort basis, and outcomes may vary depending on your system environment
3. Client Responsibilities
By engaging our Services, you agree to:
Ensure you are the legal owner of, or have authorisation to access, the device(s) being serviced
Maintain any software installed, including licences, updates, and renewals
Follow all cybersecurity best practices and post-service guidance provided
Release Protect Your PC from liability arising from user error, negligence, or failure to follow advice after service
4. Software Licensing & Installation Disclaimer
4.1 We may recommend, install, or configure third-party software, including antivirus products such as ESET, as part of our Services.
4.2 You acknowledge and agree that:
We are not the developer, vendor, or licensor of any third-party software
We do not guarantee long-term performance, compatibility, or effectiveness of third-party software
Any licensing, renewals, support, or compliance obligations are solely your responsibility
Any disputes, technical issues, or warranty claims relating to third-party software must be directed to the respective software provider
4.3 You accept all risks associated with software installation and configuration, including potential system conflicts, incompatibilities, or temporary loss of functionality.
5. Limitation of Liability
To the maximum extent permitted by law:
Protect Your PC, its owners, employees, contractors, and affiliates shall not be liable for:
Loss or corruption of data, files, or software
System downtime, device malfunction, or reduced performance
Financial, operational, or productivity loss
Issues arising from third-party software, pre-existing system issues, or user error
Our total liability, if any, is strictly limited to the amount paid for the specific Service provided.
6. No Guarantee of Absolute Security
6.1 No IT service, software, or configuration can provide 100% protection against all current or future cyber threats.
6.2 While we use industry-standard tools and methods, ongoing system security depends on:
Safe user behaviour
Regular updates and maintenance
Adherence to cybersecurity best practices
7. Remote Access Terms
7.1 By permitting remote access, you agree that:
Access will be provided via secure third-party tools such as Zoom, Microsoft Teams, RustDesk, and ESET software
We will only access areas strictly necessary to perform the requested work
You may terminate the session at any time
We do not store, retain, or copy your personal data, login credentials, or files beyond the session
8. Governing Law and Jurisdiction
These Terms are governed by the laws of the State or Territory of Australia in which you reside or conduct business. Any disputes will be resolved exclusively in the courts of that jurisdiction.
9. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies rights under the Australian Consumer Law (ACL) that cannot be excluded. Where permissible:
Our liability is limited to re-supplying the Service or refunding the cost of the Service provided
All other warranties, guarantees, or implied terms are expressly disclaimed
10. Acceptance of Terms
By engaging our Services, you confirm that:
You have read and fully understood these Terms
You accept all risks associated with remote access, virus removal, and software installation
You agree that Protect Your PC will not be held liable beyond the limitations expressly stated
